More accessible and easier to use than Incoterms <span style=\"font-size: 14pt;\"><sup>\u00ae <\/sup><\/span>2010 , Incoterms <span style=\"font-size: 14pt;\"><sup>\u00ae <\/sup><\/span>2020\u00a0 includes more detailed explanatory notes with enhanced graphics to illustrate the responsibilities of importers and exporters for each Incoterms <span style=\"font-size: 14pt;\"><sup>\u00ae<\/sup><\/span> rule.. The introduction to\u00a0 Incoterms <span style=\"font-size: 14pt;\"><sup>\u00ae <\/sup><\/span>2020 also includes a more detailed explanation on how to choose the most appropriate Incoterms <span style=\"font-size: 14pt;\"><sup>\u00ae<\/sup><\/span>\u00a0rule for a given transaction.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-size: 12pt;\"><strong>The most important changes made by ICC to the Incoterms <span style=\"font-size: 14pt;\"><sup>\u00ae <\/sup><\/span>2010 \u00a0rules in the \u00a0Incoterms <span style=\"font-size: 14pt;\"><sup>\u00ae <\/sup><\/span>2020 are the following:<\/strong><\/span><\/p>\n<ul>\n<li><span style=\"font-size: 12pt;\">There is a change in the three-letter name for Delivered at Terminal (DAT) to DPU (Delivered at Place Unloaded) \u2013 Previously, the word \u201cTerminal\u201d was confusing, but now DPU term covers all delivery options.<\/span><\/li>\n<li><span style=\"font-size: 12pt;\">Bills of lading with an on-board notation and the FCA Incoterms <span style=\"font-size: 14pt;\"><sup>\u00ae<\/sup><\/span>\u00a0rule.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-size: 12pt;\"><strong>Other relevant changes made by Incoterms <span style=\"font-size: 14pt;\"><sup>\u00ae<\/sup><\/span> 2020:<\/strong><\/span><\/p>\n<ul>\n<li><span style=\"font-size: 12pt;\">Different levels of insurance cover in CIF and CIP &#8211; the level of insurance continues to be negotiable between the buyer and the seller.<\/span><\/li>\n<li><span style=\"font-size: 12pt;\">Arranging for carriage with seller\u2019s or buyer\u2019s own means of transport in FCA, DAP, DPU and DDP.<\/span><\/li>\n<li><span style=\"font-size: 12pt;\">Inclusion of security-related requirements within carriage obligations and costs.<\/span><\/li>\n<\/ul>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row css=&#8221;.vc_custom_1603977015735{margin-top: 30px !important;margin-bottom: 60px !important;padding-top: 20px !important;}&#8221;][vc_column width=&#8221;1\/2&#8243; offset=&#8221;vc_col-lg-12 vc_col-md-12&#8243; css=&#8221;.vc_custom_1603281567718{margin-bottom: 30px !important;}&#8221;][vc_custom_heading text=&#8221;Rules for any mode or modes of transport&#8221; font_container=&#8221;tag:p|font_size:36|text_align:center|color:%23000000&#8243; google_fonts=&#8221;font_family:Open%20Sans%3A300%2C300italic%2Cregular%2Citalic%2C600%2C600italic%2C700%2C700italic%2C800%2C800italic|font_style:600%20bold%20regular%3A600%3Anormal&#8221; css=&#8221;.vc_custom_1604326305474{margin-bottom: 38px !important;}&#8221;][vc_tta_accordion style=&#8221;outline&#8221; shape=&#8221;square&#8221; color=&#8221;theme_style&#8221; c_icon=&#8221;chevron&#8221; c_position=&#8221;right&#8221; active_section=&#8221;-1&#8243; no_fill=&#8221;true&#8221;][vc_tta_section title=&#8221;EXW \u2013 Ex Works&#8221; tab_id=&#8221;116043261724621604411850616&#8243;][vc_column_text]It is an international trade term that describes when a seller makes a product available at a designated location. At this point, the buyer gains ownership of the goods. Then, he handles all costs and risk after the products are collected.<\/p>\n<p>Ex Works is most favourable to the seller. He has no obligation to load the goods or to cover freight costs once the goods have left the premises. This term can cause complications for the buyer if products are for export.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;FCA \u2013 Free Carrier&#8221; tab_id=&#8221;216043261724621604411850616&#8243;][vc_column_text]With FCA, the seller is responsible for delivering the goods to the buyer\u2019s nominated premises. He needs to load the stocks onto the buyer\u2019s transportation. Then, the seller organises the transport, including export clearance and meeting security requirements.<\/p>\n<p>The risk is transferred once the goods are loaded onto the buyer\u2019s transportation. Thus, any damage to the products when on board the vessel is the responsibility of the buyer.<\/p>\n<p>The buyer pays the cost of freight, bill of lading fees and insurance. Also, he pays for unloading and transportation costs to the final destination.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;CPT \u2013 Carriage Paid To&#8221; tab_id=&#8221;316043261724621604411850616&#8243;][vc_column_text]The Seller delivers and transfers risk of loss or damage by handing over goods to the carrier chosen by the seller, cleared for export, who pays for moving the goods to the named place of destination. His responsibilities include packing, export clearance, carriage expenses and any terminal costs up to the agreed destination port.<\/p>\n<p>DAP means the buyer is responsible for all costs, duties and taxes associated with unloading the goods. He is also responsible for clearing customs to import the products into the named country of destination.<\/p>\n<p>The risk is transferred to the buyer at the final designated place of destination[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;DPU \u2013 Delivered at Place Unloaded&#8221; tab_id=&#8221;616043261724621604411850616&#8243;][vc_column_text]This term is often used for consolidated containers with multiple consignees. It is the only term that tasks the seller with unloading the goods.<\/p>\n<p>The seller covers all the costs of transportation (export fees and carriage). Also, at the destination port, the seller pays the unloading from the carrier and the port charges. He assumes all risks until arrival at the destination port or terminal.<\/p>\n<p>The buyer is responsible for all costs and risks after unloading. It includes import duties, taxes and customs clearance. Also, the buyer pays local transportation to the final named place of destination.<\/p>\n<p>If the seller is not able to organise unloading, he should consider transport under DAP terms instead.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;DDP \u2013 Delivered Duty Paid&#8221; tab_id=&#8221;716043261724621604411850616&#8243;][vc_column_text]DDP means the seller bears all risks and costs associated with clearing and delivering the goods to the designated place.<\/p>\n<p>The seller is liable for clearing the goods through customs in the buyer\u2019s country. It includes payment of both duties and taxes. Furthermore, he needs to obtain the necessary authorisations and registrations from the authorities. However, the seller is not responsible for unloading.<\/p>\n<p>This term places the maximum obligations on the seller and minimum obligations on the buyer. It means that the buyer bears all costs and risks of loss or damage from that moment.<\/p>\n<p>The FAS term requires the seller to clear the goods for export (under previous Incoterms <span style=\"font-size: 12pt;\"><span style=\"font-size: 14pt;\"><sup>\u00ae<\/sup><\/span><\/span>, the buyer arranged export clearance).[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;FOB \u2013 Free on Board&#8221; tab_id=&#8221;916043261963811604411876719&#8243;][vc_column_text]Under FOB terms, the seller bears costs and risks until the goods are loaded on board of the designated vessel.<\/p>\n<p>The seller\u2019s responsibility includes arranging export clearance. At the same time, the buyer pays the cost of marine freight, bill of lading fees and insurance. He is also responsible for unloading and local transportation costs from the port of arrival to the final destination.<\/p>\n<p>Any damage to the goods when on board the vessel is the responsibility of the buyer.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;CFR \u2013 Cost and Freight&#8221; tab_id=&#8221;1016043261963811604411876719&#8243;][vc_column_text]CFR incurs more significant risk and responsibility for the seller who pays for the carriage of the goods up to the named port of destination.<\/p>\n<p>The risk is transferred to the buyer at the country of export. Specifically, when the goods have been loaded on board the ship.<\/p>\n<p>The shipper pays for export clearance and freight costs to the selected port. Furthermore, he is responsible for any damage to the goods on board the ship until the port of final destination.<\/p>\n<p>The buyer pays for local delivery from the port to the final destination and is responsible for purchasing insurance. If the buyer requires the seller to obtain insurance, the parties should consider the Incoterm <span style=\"font-size: 12pt;\"><span style=\"font-size: 14pt;\"><sup>\u00ae<\/sup><\/span><\/span> \u00a0CIF instead.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;CIF \u2013 Cost, Insurance and Freight&#8221; tab_id=&#8221;1116043261963811604411876719&#8243;][vc_column_text]The seller clears the goods for export and delivers them when they are on board at the port of shipment. The seller bears the cost of freight and insurance to the designated port of destination. Also, he is responsible for any damage to the goods on board the ship.<\/p>\n<p>The seller needs to purchase the minimum level of insurance under Clause C of the Institute Cargo Clauses. (This requirement is unchanged from Incoterms <span style=\"font-size: 12pt;\"><span style=\"font-size: 14pt;\"><sup>\u00ae<\/sup><\/span><\/span> 2010.)<\/p>\n<p>At the port of arrival, the seller must turn over three key documents \u2013 invoice, insurance policy and bill of lading.
